Agroecologia e indústria farmacêutica : implicações jurídicas, políticas e de saúde

Abstract

O presente trabalho tem por objetivo realizar um delineamento das políticas públicas do Estado brasileiro para o incentivo da Agroecologia, em contraposto com os incentivos oferecidos à indústria farmacêutica. Na construção do trabalho, se analisou os aspectos legais e jurídicos dos incentivos públicos às indústrias farmacêuticas e para a Agroecologia; o consumo de medicamentos, o lobby existente entre a indústria farmacêutica e a classe médica; e a influência da Agroecologia na saúde de produtores que realizaram a transição agroecológica. A metodologia utilizada foi de revisão narrativa e comparativa entre as políticas públicas de incentivos à indústria farmacêutica no Brasil, da revisão bibliográfica da legislação vigente, da literatura farmacêutica, médica, de decisões judiciais e de doutrinas pertinentes ao tema, em sites públicos e especializados. O resultado do estudo mostrou a existência de uma série de incentivos à indústria farmacêutica, a qual se beneficia na mercantilização de seus produtos, ao passo que os incentivos à Agroeocologia são recentes e tímidos, representando valores irrisórios se comparados àqueles atribuídos às atividades rurais convencionais. Com relação à saúde de produtores agroecológicos, estudos demonstram que a transição agroecológica trouxe uma série de benefícios, inclusive a redução ou eliminação do uso de medicamentos e suas intoxicações, bem como outros benefícios à saúde, graças à diminuição do uso de agrotóxicos e do aumento do consumo de alimentos saudáveis. Também buscou-se avaliar a conduta do presente governo, tanto com relação aos incentivos dados à Agroecologia, quanto aos seus atos perante a pandemia da COVID-19

This paper aims to outline the public policies of the Brazilian State to encourage Agroecology, as opposed to the incentives offered to the pharmaceutical industry. In the construction of the work, the legal and legal aspects of public incentives for the pharmaceutical industries and for Agroecology were analyzed, the consumption of medicines, the existing lobby between the pharmaceutical industry and the medical profession and the influence of Agroecology on the health of producers who carried out the agroecological transition. The methodology used was a narrative and comparative review, among the public policies of incentives to the pharmaceutical industry in Brazil, a bibliographic review of the current legislation, of the pharmaceutical and medical literature, of judicial decisions and of doctrines pertinent to the theme, on public and specialized websites. The result of the study showed the existence of a series of incentives to the pharmaceutical industry, which benefits from the commercialization of its products, while the incentives to Agroeocology are recent and timid, representing ridiculous values when compared to those attributed to conventional rural activities. Regarding the health of agroecological producers, studies show that the agroecological transition brought a series of benefits, including the reduction or elimination of the use of medicines and their intoxications, as well as other health benefits, thanks to the decrease in the use of pesticides and the increase consumption of healthy food. It also sought to evaluate the conduct of the present government, both in relation to the incentives given to Agroecology and to its actions in the face of the COVID-19 pandemic
